Thank you for participating in the Harley Benton THE CLUB Newsletter Giveaway. The following Terms & Conditions govern participation in the giveaway and the selection of the winner.

§ 2 Giveaway Details

Title: THE CLUB – Newsletter Giveaway January 2026
Giveaway Period: January 1, 2026 – January 31, 2026 (end of day)
Prize: SC-Custom III Ocean Flame
Number of Prizes: One (1) prize per giveaway period

§ 3 Eligibility

(1) Participation is open to individuals who are 18 years of age or older at the time of entry.

(2) Participation is only possible for persons residing in countries to which Thomann ships products.

(3) Employees of Thomann GmbH, Harley Benton and their relatives are excluded from participation.

§ 4 Participation

(1) Participation in the giveaway is only possible via THE CLUB newsletter.

To enter the giveaway, participants must:

-> Be subscribed to the THE CLUB – Harley Benton Newsletter, and
-> Click the giveaway participation button included in the dedicated giveaway newsletter

By clicking the participation button, participants confirm their entry and explicitly agree to these Terms & Conditions. No further confirmation is required.

(2) Participation is free of charge.

(3) Participation is only valid if the newsletter subscription remains active until the end of the giveaway period. If a participant unsubscribes from THE CLUB newsletter before the giveaway ends, their participation will be void.

(4) Each participant may enter the giveaway once per giveaway period.

§ 5 Winner Selection & Notification

(1) The winner will be selected at random from all eligible participants after the end of the giveaway period.

(2) The winner will be contacted and notified by email during the first week of the month following the giveaway period, using the email address associated with their newsletter subscription.

(3) The winner must confirm acceptance of the prize and provide the necessary information for shipment within a reasonable period specified in the notification. If the winner does not respond within this period, the organizer reserves the right to select a new winner.

§ 6 Prize Delivery, Shipping & Customs

(1) The prize will be shipped free of charge by Thomann GmbH or a logistics partner commissioned by Thomann GmbH.

(2) In some countries, customs duties, import taxes, tariffs or other charges may apply upon delivery. To receive the shipment, the winner must pay these charges upfront – after delivery, the winner can submit the relevant payment receipts to Thomann GmbH, and the costs will be reimbursed.

(3) The prize is non-transferable and cannot be exchanged for cash or another product.

(4) The product shown or described in promotional materials may differ slightly in model, color or specifications from the actual prize.

§ 7 Thomann Customer Account

(1) For the purpose of prize delivery, warranty handling and legal documentation, the organizer may create or use an existing Thomann customer account for the winner.

(2) The account will only be used for purposes related to the giveaway prize (e.g. shipment, warranty, invoicing requirements) and in accordance with applicable data protection laws.

§ 8 Data Protection

(1) Personal data provided by participants will be processed solely for the purpose of conducting the giveaway, selecting the winner, contacting the winner and delivering the prize.

(2) By participating in the giveaway, participants agree to the processing of their personal data as described above.

(3) Participants may withdraw their consent at any time.
Please note that withdrawing consent or unsubscribing from the newsletter before the end of the giveaway period will result in exclusion from the giveaway.

§ 9 Liability

(1) Thomann GmbH is released from all obligations upon delivery of the prize.

(2) Thomann GmbH shall not be liable for the insolvency of third-party service providers involved in the execution of the giveaway.

§ 10 Miscellaneous

(1) Legal recourse is excluded.

(2) The laws of the Federal Republic of Germany shall apply exclusively, excluding conflict-of-law provisions.

(2) A Harley Benton Guitar/Bass and Harley Benton Amp of choice. The prize is awarded once.

§ 2 Participation

(1) Only persons of full age are entitled to participate.

(2)  Subscribe to the Harley Benton YouTube Channel and comment on what Harley Benton gear you would like to get. By submitting a comment under the respective competition video, the individual participant agrees to these conditions of participation.

(3) The competition runs until December 16, 2025, 12:00 (noon) (GMT+2) inclusive, any comments made after that time will not be entered into the draw.

§ 3 Exclusion from the contest

(1) Employees of Thomann GmbH, the cooperation partners involved and their respective relatives (e.g. parents, siblings, spouses) are excluded from participation.

(2) In the event of a violation of these conditions of participation, in particular through the use of unauthorized aids and other manipulations, the organizer reserves the right to exclude persons from the competition. If necessary, prizes can also be withdrawn and reclaimed subsequently in the event of such infringements.

§ 4 Implementation and processing

(1) After the correct participation listed above, the random generator will select the lucky winner from all participants who answered the question correctly. If the participants have won their desired prize, they will be informed in a YouTube commentary under the corresponding lottery and contacted by the organizer on YouTube. In this message, the organizer informs the winner about the next steps. The winners will confirm to the Promoter that they accept the prize and provide the information necessary for the transmission of the prize within the period specified in the prize notification.

The claim to the prize lapses if the award or transmission of the prize cannot take place for reasons attributable to the person of the winner. This applies in particular if a winner does not confirm acceptance of the prize in due time. In this case, the organizer reserves the right to determine a new winner by lot.

(2) The object presented as a prize within the scope of the competition is not necessarily identical with the object won. There may be deviations with regard to the model, colour or similar.

(3) The material prizes will be sent by the organiser or a third party commissioned by the organiser to the postal address to be provided by the winner by forwarding agent, parcel service or post.

Delivery is free of charge. Any additional transport costs and customs duties shall be borne by the winner. In the event that delivery is made by a forwarding agent, the forwarding agent will contact the winner to arrange a delivery date.

(4) An exchange of the prizes, a cash payment or a possible replacement of the prize is excluded.

(5) The claim to the prize or compensation cannot be assigned to third parties.

§ 5 Data protection

(1) The participant agrees that the organizer may store all data required for the execution of the lottery for the duration of the lottery. The organizer has partially transferred services which are necessary for the execution and handling of the lottery to third parties (“cooperation partners”). The data of the participants will be stored by the cooperation partner(s) for the execution and handling of the competition for the duration of the competition. All data will be deleted after the end and processing of the lottery.

By participating in this competition, the participants agree that their data may be processed by third parties for the aforementioned purposes, in particular that they may be transferred by the organizer to third parties. Participants may revoke their consent to the processing of their data at any time. In this case, however, the organizer may have to exclude them from further participation. Furthermore, they have the rights to information and correction guaranteed by the Federal Data Protection Act with regard to the data collected.

2) The organizer agrees to protect the privacy of the participants and assures to process the data in accordance with the Federal Data Protection Act, the Telemedia Act as well as the European Data Protection Directive (95/46/EC) and the EU Data Protection Directive for Electronic Communications 02/58/EC. 

§ 6 Liability

(1) Thomann GmbH shall be released from all obligations upon handover of the prize.

(2) Thomann GmbH shall not be liable for the insolvency of a cooperation partner or the resulting consequences for the execution and handling of the competition.

§ 7 Miscellaneous

(1) Legal recourse is excluded.

(2) The law of the Federal Republic of Germany shall apply exclusively, excluding the reference provisions of international private law.
